Forfeitures –The U.S. Government and the State of Florida are permitted to seize and forfeit, either through criminal or civil proceedings, property that was used to facilitate crime and property that was obtained with the proceeds of crime. Any property (including interest in property) may be forfeited, including but not limited to bank accounts, homes, boats, cars, leases, and a lender’s security interest.
Having your property seized by the Government due to a criminal or civil proceeding is a challenging life event one can face. However, it is important to know that the legal process does not end with your property being forfeited by the Government. The Fourth Amendment grants protections against unreasonable searches and seizures. This can be applied in forfeiture cases involving seizures and may be raised as a defense in forfeiture proceedings where the defendant claims the property sought to be forfeited was seized from him/her pursuant to an unlawful search and or seizure.
